Terms of Service

1. Acceptance of Terms

By accessing or using PdfWatch ("the Service"), you agree to be bound by these Terms of Service. This is a legally binding contract between you and PdfWatch. If you do not agree to these terms, you may not access or use the Service.

2. Acceptable Use

PdfWatch provides secure infrastructure, but you are solely responsible for the content you upload, share, and distribute. You explicitly agree NOT to use the Service to:

  • Upload, share, or distribute illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable material.

  • Infringe upon any patent, trademark, trade secret, copyright, or other proprietary rights of any party.

  • Distribute malware, viruses, or any other malicious code designed to compromise systems.

  • Misrepresent identity for the purpose of credential theft (phishing) or social engineering.

3. Intellectual Property

You own your data. You retain all rights, title, and ownership to the documents you upload.

By using the Service, you grant us a limited, non-exclusive, royalty-free license to store and transmit the encrypted blobs solely for the purpose of providing the Service to you. Because the data is encrypted with keys we do not possess, this license does not grant us the ability to read, modify, or use your original content in any way.

4. Safe Harbor & Neutral Transit

PdfWatch provides end-to-end encrypted transit. We do not possess the keys to decrypt user content. We intend to operate as a service provider under applicable safe harbor frameworks (such as 17 U.S.C. § 512), and we do not initiate, select, or modify the content of the transmissions.

We rely on user reporting to identify abuse. If a document is reported for violating our policies, we may suspend access to the encrypted blob or delete it entirely, without needing or having the ability to inspect its contents.

5. Limitation of Liability (The Zero-Knowledge Caveat)

Our greatest security feature is also our greatest limitation of liability. We do not have your decryption keys.

You are entirely responsible for managing and securing the links generated by PdfWatch. If you lose a link, the document is permanently inaccessible. We cannot recover it for you, nor can we be held liable for any data loss resulting from lost keys.

In no event shall PdfWatch, its directors, employees, or agents, be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use or the inability to use the Service.

6. Account Termination

We reserve the right to suspend or terminate your account and permanently delete your encrypted blobs at our sole discretion, without prior notice, if we determine you have violated these Terms of Service, or in response to a valid legal request from law enforcement.

7. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the competent courts of that jurisdiction.

8. DMCA & Copyright Policy

PdfWatch respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). To report copyright infringement, please see our DMCA Policy at pdfwatch.com/dmca or email [email protected]. We will respond to valid notices within 2 business days. Repeat infringers will have their access terminated.
